Jason Pastore, 36, of Yonkers was charged after an officer noticed a black Jeep traveling westbound on Route 6 in Yorktown failed to exercise due care while traveling by an officer, police said.
After the vehicle was stopped, an investigation revealed Pastore was intoxicated, police said. He also refused a prescreening breath test, police said.
Pastore was transported to police headquarters and was released on $100 bail. He is due back in court on Sept. 21.
In 2015, Pastore was sentenced to 12 months in prison for filing false tax returns on behalf of his clients while running a tax return business in Rochester.
